We are committed to providing all Program participants with a positive experience. Thus, Surfside Junk Solutions LLC may, at its sole discretion, limit, suspend, or terminate your participation in any of its programs, live, recorded, social media-based or digital without refund or forgiveness of remaining payments due if you:

(a) Fail to make program/financing payments;
(b) Become disruptive or difficult to work with;
(c) Fail to follow the Program guidelines; or
(d) Impair the participation of our employees, contractors, clients, instructors or participants in any of our programs.

Accuracy of Information

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or on any related Service is inaccurate at any time without prior notice (including after you have submitted your order). We respect your confidential and proprietary information, ideas, plans and trade secrets (collectively, "Confidential Information") and must insist that you respect the same rights of fellow Program participants and of Surfside Junk Solutions LLC. Thus, you agree:

(a) Not to infringe upon any Program participant’s or Surfside Junk Solutions LLC copyrights, patents, trademarks, trade secrets or other intellectual property rights;
(b) That any Confidential Information shared by Program participants or any representative of Surfside Junk Solutions LLC is confidential and proprietary, and any such Confidential Information belongs solely and exclusively to the party who discloses such information;
(c) Not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;
(d) That all materials and information provided to you by Surfside Junk Solutions LLC are confidential and proprietary intellectual property which belongs solely and exclusively to Surfside Junk Solutions LLC, and may only be used by you as authorized in writing by Surfside Junk Solutions LLC;
(e) Reproduction, distribution, or sale of these materials by anyone but Surfside Junk Solutions LLC is strictly prohibited; and
(f) That if you violate, or display any likelihood of violating, any of the sections contained in this paragraph or referenced in this Agreement, Surfside Junk Solutions LLC and/or other Program participants will be entitled to injunctive relief against you for any such violations.

A breach of any of the promises or agreements contained herein will result in irreparable and continuing damage to Surfside Junk Solutions LLC for which there will be no adequate remedy at law, and Surfside Junk Solutions LLC shall be entitled to injunctive relief and/or a decree for specific performance, and such other relief as may be proper (including monetary damages, and attorney’s fees if appropriate). While you are free to discuss your individual results from this Program or any other Surfside Junk Solutions LLC program or training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.

Non-Solicitation

You agree with and for the benefit of Surfside Junk Solutions LLC that, during the Program and for a period of two (2) years after separation from the Program (whether such separation results from early termination or successful completion), you will not (except with the prior written consent of Surfside Junk Solutions LLC), directly or indirectly:

(a) Compete with Surfside Junk Solutions LLC to provide the same or similar services which Surfside Junk Solutions LLC is currently providing to any of these individuals or companies;
(b) Encourage any person to leave the employ or engagement of Surfside Junk Solutions LLC;
(c) Sell or offer for sale or solicit orders for the sale of any products or services.

Note: If there is natural synergy to sell your products or services to any of the persons, clients, employees, companies or institutions with whom you had dealings through the Program — that is fine. However, we do not tolerate blatant pitching or soliciting.

Reviews, Testimonials and Pictures/Videos

You hereby consent to the use of your name, photograph, likeness, voice, testimonial and biographical material, in whole or in part, for publication or reproduction in any medium, for any purpose, including but not limited to public relations, education, advertising, marketing, training and research. Your consent is granted to Surfside Junk Solutions LLC and extends without restriction or limitation as to time or geographic boundary.

You waive all rights to any claims or demands for payment or royalties in connection with such use or publication, regardless of whether a fee is charged or collected by Surfside Junk Solutions LLC. You also waive the right to inspect, review or approve any such material.

Note: As a professional courtesy, we will always contact you to ask for your explicit permission if we would like to use your testimonial in our marketing.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Surfside Junk Solutions LLC, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, punitive, cover or consequential damages. The aggregate liability of Surfside Junk Solutions LLC for any claims shall not exceed one dollar or the amount you actually paid to Surfside Junk Solutions LLC for the prior one month period.

Severability

If any provision of this Agreement is held to be unlawful, void, or unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of the remaining provisions.

Governing Law, Jurisdiction & Arbitration

All matters relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Florida, without regard to its conflict of law provisions.

Any legal suit, action or proceeding arising out of, or related to this Agreement shall be instituted exclusively in the state or federal district courts located in St. Johns County, Florida, and you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

At the Company’s sole discretion, it may require you to submit any disputes arising from this Agreement to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Florida law.

Assignment

You may not assign, resell, sub-license or otherwise transfer any of your rights or obligations without prior written consent. We may assign any of our rights or obligations to a third-party as part of a sale or merger.

Electronic Signature

By using the Company website or communicating via email, SMS, or any digital method, you agree that such communications are legally binding and equivalent to signed, written documents.

Changes and Amendments

We reserve the right to update or modify this Agreement at any time, effective upon posting on our Website.

Acceptance of These Terms

You acknowledge that you have read this Agreement and agree to its terms. If you do not agree, you are not authorized to use the Website or Services.
